Money matters. Matters of relationship. That is the business of justice.&nbsp;<\/p>\n\n\n\n<p>Delivering fair solutions, whilst making costs and collecting revenues. Like any business.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In 2018, I published <a href=\"https:\/\/www.hiil.org\/projects\/understanding-justice-needs-the-elephant-in-the-courtroom\/\">Understanding Justice Needs<\/a> with colleagues near and far.<\/p>\n\n\n\n<p>In it, we answered 9 key questions and<strong> <\/strong>suggested 10 opportunities for major investment to close the justice gap. <br><\/p>\n\n\n\n<p>This year, I am co-writing our next <a href=\"https:\/\/www.hiil.org\/projects\/?_sf_s=Trend%20report\">report<\/a> on making justice available to everyone.&nbsp;<\/p>\n\n\n\n<p>Allow me to give you a preview.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Basic justice can be available for everyone&nbsp;<\/strong><\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.justice.sdg16.plus\/report\">Task Force on Justice<\/a> identified the <a href=\"https:\/\/worldjusticeproject.org\/our-work\/publications\/special-reports\/measuring-justice-gap\">justice gap<\/a>: 5 billion people do not get basic justice.<\/p>\n\n\n\n<p>Individuals that are living outside the rule of law, struggling to solve everyday justice problems or living and working informally, lacking both protection and opportunities.&nbsp;<\/p>\n\n\n\n<p>The <a href=\"http:\/\/oecd.org\/gov\/equal-access-to-justice-for-inclusive-growth-597f5b7f-en.htm\">OECD<\/a> and the <a href=\"https:\/\/www.justice.sdg16.plus\/report\">Innovation Working Group<\/a> of the Task Force tell us well-designed solutions are possible, yet requiring investments.&nbsp;<\/p>\n\n\n\n<p>Courts, prosecution, police and legal aid providers all suffer from resource constraints.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Funding needs are becoming more clear<\/strong><\/h2>\n\n\n\n<p>The costs of scalable, innovative universal basic justice have been estimated by <a href=\"https:\/\/www.odi.org\/sites\/odi.org.uk\/files\/resource-documents\/12702.pdf\">ODI<\/a>.<\/p>\n\n\n\n<p>It is less than I thought it would be.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh6.googleusercontent.com\/mfZxCTa69ZWEBTyJi-gtcMdtlSrLYiN_XRRrB7pp00OqFEYy6v8mhjGxJ4NiI7t82LzNn35u3dmoTtMaY0LAcTGttpmAd4IaXnmcSFX3lMZjxc9Xp8KxfEfOXWQXt0KLItQLrYE7\" alt=\"\"\/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>65 &#8211; 85% of budgets are needed for formal state institutions and accountability (see Table).<\/p>\n\n\n\n<p>Most resolution happens <a href=\"https:\/\/worldjusticeproject.org\/our-work\/research-and-data\/global-insights-access-justice-2019\">out of court<\/a>, so funds for informal mechanisms are needed as well.<\/p>\n\n\n\n<p>So where do revenues come from?&nbsp;&nbsp;<\/p>\n\n\n\n<p>Governments will spend a maximum of 4% in tax revenues on justice (<a href=\"https:\/\/www.odi.org\/sites\/odi.org.uk\/files\/resource-documents\/12702.pdf\">IMF and World Bank<\/a> data) and users of the justice system are also contributing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Dividing the budgets, increasing the pie<\/strong><\/h2>\n\n\n\n<p>Our report will summarize how police, courts, prosecution services, legal aid services, and informal justice\/ADR each obtain a share of the justice budget.&nbsp;<\/p>\n\n\n\n<p>Is the current allocation effective in order to achieve the outcomes that are needed?<\/p>\n\n\n\n<p>Our focus will be on how to increase the available resources.&nbsp;<\/p>\n\n\n\n<p>How can the sector mobilize extra revenue for basic justice?&nbsp;<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Making people want to invest in justice<\/strong><\/h2>\n\n\n\n<p>(Well-designed) Justice may be attractive for <a href=\"https:\/\/worldjusticeproject.org\/world-justice-forum-vi\/what-will-it-take-bring-social-impact-investing-justice-sector\">social impact investors<\/a>.&nbsp;<\/p>\n\n\n\n<p>Users may want to pay more if they are served in a better way.<\/p>\n\n\n\n<p>Most justice problems are local, and communities need fairness, law, and predictability.&nbsp;<\/p>\n\n\n\n<p>So we will look at resources in the community.<\/p>\n\n\n\n<p>Volunteers and professional services can both contribute.&nbsp;<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Three models of justice delivery case studies will inform the findings in our upcoming report<\/strong><\/h2>\n\n\n\n<p>Together with our partners, we selected three case studies.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/lh6.googleusercontent.com\/2TJ-6Xy5NrBMdeoEu3BG1OL0soF-o57b_j3vpSxZyW17KEMKpoZw_JQYe7hr_5b9diQ1SmHXdQ_jUe8VTRyIYDhQselwpEYl-5jWuQFAujz7s4jD5UH8FhuQGnIW9gDqgO_gPfhz\" alt=\"\" width=\"500\" height=\"417\"\/><\/figure><\/div>\n\n\n\n<p>From these case-studies, we will try to find common themes.
