This question echoed throughout the recently concluded 4th National Alternative Justice Systems (AJS) Conference, held in Embu, Kenya, from the 16th to the 19th of June 2026. Over four days, judges, community justice practitioners, researchers, civil society organisations, county governments, and development partners came together to reflect on the future of people-centred justice. Despite the diversity of perspectives, one question repeatedly surfaced: How do we measure the outcomes of Alternative Justice Systems?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The discussion was not simply about whether disputes had been resolved. Instead, it challenged us to think more deeply about whether people&rsquo;s lives, relationships, and communities had actually improved as a result of those justice processes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Why the AJS Conference Mattered<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution of Kenya recognises alternative forms of dispute resolution as an important avenue for expanding access to justice. Building on this constitutional mandate, the Judiciary adopted the Alternative Justice Systems Policy, formally recognising AJS as a vital component of Kenya&rsquo;s justice system. Today, an estimated 64% of Kenyans rely on AJS to resolve their disputes, compared to approximately 17% who turn to the courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c<em>AJS are not just an alternative for the vast majority of Kenyans. They are the primary choice.<\/em>\u201d&nbsp; H.E. Patrick Ole Ntutu, Governor, Narok County<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet perhaps the most significant message from this year&rsquo;s conference was that AJS has evolved beyond being a policy aspiration. It is now a lived reality for millions of Kenyans. The challenge is no longer whether AJS has a place within the justice system, but rather how to demonstrate its value and measure its contribution to people&rsquo;s lives.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"1234\" height=\"823\" src=\"https:\/\/www.hiil.org\/wp-content\/uploads\/2026\/07\/image.jpeg\" alt=\"\" class=\"wp-image-27364\" srcset=\"https:\/\/www.hiil.org\/wp-content\/uploads\/2026\/07\/image.jpeg 1234w, https:\/\/www.hiil.org\/wp-content\/uploads\/2026\/07\/image-300x200.jpeg 300w, https:\/\/www.hiil.org\/wp-content\/uploads\/2026\/07\/image-768x512.jpeg 768w\" sizes=\"(max-width: 1234px) 100vw, 1234px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Rethinking How We Measure Justice<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One message emerged consistently across the conference: traditional justice metrics are too narrow to capture the full value of Alternative Justice Systems. Court systems have historically measured success through indicators such as cases filed, cases concluded, clearance rates, and time taken to resolve disputes. While these metrics remain important, they tell only part of the story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c<em>We must move from counting cases to measuring justice, from throughput to outcomes, from efficiency to human flourishing. That is the future.<\/em>\u201d Hon. Mr Justice (Prof) Joel Ngugi, Chair, NaSCI-AJS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Participants called for broader approaches to measuring justice that reflect the AJS&rsquo;s unique strengths. These include:<\/p>\n\n\n\n<ul style=\"background-color:#ffddc8\" class=\"wp-block-list has-background\">\n<li><strong>Resolution benefits<\/strong>: Was the dispute resolved in a manner acceptable to those involved?<\/li>\n\n\n\n<li><strong>Relational benefits<\/strong>: Were damaged relationships repaired? Was trust restored?<\/li>\n\n\n\n<li><strong>Preventive benefits<\/strong>: Did the process reduce the likelihood of future disputes?<\/li>\n\n\n\n<li><strong>Healing benefits<\/strong>: Did the process promote reconciliation, dignity, and emotional healing?<\/li>\n\n\n\n<li><strong>Community benefits<\/strong>: Did it strengthen peace, social cohesion, accountability, and resilience?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These outcomes are undoubtedly more difficult to quantify than case disposal rates. However, as many participants observed, the fact that something is difficult to measure should not become a reason for overlooking it. If justice is ultimately about improving people&rsquo;s lives, then our methods of measuring justice must evolve to reflect that reality. One of the conference&rsquo;s most compelling insights was that Africa&rsquo;s plural legal systems may offer valuable lessons for the global justice community. By recognising and measuring the broader social value created through community-based justice, Kenya&rsquo;s AJS movement has the potential to help reimagine how justice systems around the world define and assess success.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perhaps the most important takeaway from Embu is that Kenya is no longer asking whether Alternative Justice Systems belong within the justice sector. The conversation has shifted to understanding, documenting, and learning from the impact they are already having. This shift comes at an opportune moment. The conference laid a strong foundation for the upcoming Justice Needs Survey and AJS benefit-mapping study, which seeks to comprehend the tangible value that AJS delivers to individuals, communities, and institutions.
