The committee is the product of several months of consultations, including the <em>\u201cFor a People-Centered Justice\u201d<\/em> workshops and the Forum on the Role of Traditional Leadership in the Nigerien Justice System. Chaired by Mr. Sahirou Tchida Moussa, Deputy Secretary General of the Ministry of Justice and Human Rights, responsible for institutional relations, this meeting marks the transition from strategic development to operational implementation.<\/p>\n\n\n\n<p>As a long-standing partner in Niger\u2019s justice reform journey, we view this development as a strong institutional commitment to reducing structural inequalities in access to justice\u2014particularly in a context where formal mechanisms remain out of reach for many, and where community-based and customary actors continue to play a central role in resolving everyday disputes.<\/p>\n\n\n\n<p><strong>Embedding Justice in Local Realities<\/strong><\/p>\n\n\n\n<p>Across Niger, as in much of the Sahel, a majority of citizens resolve their disputes through informal mechanisms. Whether addressing land issues, family matters, or inter-community tensions, people often turn to traditional leaders and elders rather than to the formal justice system. This reliance is shaped by factors such as distance, cost, and trust. While these informal systems are deeply rooted and often effective, they do not always guarantee equitable outcomes. Women and young people in particular face significant barriers, and the absence of regulatory oversight can result in inconsistency or injustice. Meanwhile, the formal justice system\u2014under-resourced and concentrated in urban areas\u2014struggles to meet the broader population\u2019s needs.<\/p>\n\n\n\n<p>The strategy document, <em>\u201cFor a People-Centered Justice: Strategic Pathways Emerging from Multi-Stakeholder Consultation,\u201d<\/em> seeks to respond to these intersecting challenges. It is grounded in the principle that meaningful reform must begin with the mechanisms that people already use to seek justice. This entails strengthening the capacities of traditional authorities, ensuring their practices align with human rights and principles of equity, and building stronger linkages between informal and formal systems. At its core, this strategy reflects a conviction we share: justice should be measured not only by institutional performance, but by people\u2019s experience of being heard, protected, and treated with fairness in times of conflict.<\/p>\n\n\n\n<p><strong>The Role of the Monitoring Committee<\/strong><\/p>\n\n\n\n<p>The Monitoring Committee brings together representatives from the Ministry of Justice and Human Rights, the Ministry of Interior and Public Security, the Association of Traditional Chiefs of Niger (ACTN), civil society organizations, technical services, and financial partners. At its inaugural session, the committee adopted a shared roadmap to guide the implementation of the national strategy over the coming year. This roadmap includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An operational action plan, with defined timelines, clear roles and responsibilities, and measurable performance indicators;<\/li>\n\n\n\n<li>Coordination mechanisms designed to facilitate cooperation between ministries, local authorities, and community-based justice providers;<\/li>\n\n\n\n<li>A monitoring and evaluation framework based on quarterly meetings and regular progress reports;<\/li>\n\n\n\n<li>A public communication strategy aimed at reinforcing transparency and building citizen trust in the reform process.<\/li>\n<\/ul>\n\n\n\n<p><strong>Traditional Leadership as a Strategic Pillar<\/strong><\/p>\n\n\n\n<p>One of the most important developments in this process is the State\u2019s formal recognition of traditional leadership as a strategic component of the justice system. For too long, customary dispute resolution mechanisms have operated in parallel to the State\u2014effective in many respects, but largely unregulated. By including traditional authorities both in the strategy and its implementation, Niger is affirming their legitimacy and strengthening what already works for the majority of its citizens. The inclusion of the ACTN within the Monitoring Committee represents a major structural advance. It enables traditional leaders to contribute their knowledge and legitimacy within a framework that upholds human rights and serves the broader interests of the population.<\/p>\n\n\n\n<p><strong>From Strategy to Systemic Change<\/strong><\/p>\n\n\n\n<p>We believe the path is now set for meaningful change. With clear political will, established partnerships, and a robust implementation roadmap, the conditions are in place to translate strategic vision into tangible outcomes. The success of this reform will depend on consistent follow-through, adequate resources, ongoing engagement with citizens, and a commitment to learning throughout the process. Ce comit\u00e9 a \u00e9t\u00e9 mis en place \u00e0 l\u2019issue de plusieurs mois de consultations, men\u00e9es notamment lors des ateliers multipartites \u00ab Pour une Justice ax\u00e9e sur les personnes \u00bb et du Forum sur la place de la chefferie traditionnelle dans le syst\u00e8me judiciaire au Niger. Pr\u00e9sid\u00e9e par M. Sahirou Tchida Moussa, Secr\u00e9taire g\u00e9n\u00e9ral adjoint du Minist\u00e8re de la Justice et des Droits de l\u2019Homme, charg\u00e9 des relations avec les institutions, cette r\u00e9union marque le d\u00e9but d\u2019une nouvelle phase : celle de la mise en \u0153uvre concr\u00e8te, au-del\u00e0 de la conception.<\/p>\n\n\n\n<p>En tant que partenaire de longue date, HiiL consid\u00e8re cette \u00e9tape comme un engagement institutionnel fort, visant \u00e0 r\u00e9duire les in\u00e9galit\u00e9s d\u2019acc\u00e8s \u00e0 la justice dans un contexte o\u00f9 les m\u00e9canismes judiciaires formels restent souvent hors de port\u00e9e pour une large part de la population, et o\u00f9 les acteurs communautaires et coutumiers jouent un r\u00f4le central dans la r\u00e9solution des conflits.<\/p>\n\n\n\n<p><strong>Une Justice Ancr\u00e9e dans les R\u00e9alit\u00e9s Locales<\/strong><\/p>\n\n\n\n<p>Dans le contexte nig\u00e9rien, comme dans l\u2019ensemble de la r\u00e9gion sah\u00e9lienne, la majorit\u00e9 des citoyens ont recours \u00e0 des m\u00e9canismes informels pour r\u00e9soudre leurs diff\u00e9rends. Qu&rsquo;il s&rsquo;agisse de litiges fonciers, de conflits familiaux ou de disputes communautaires, les populations se tournent vers les autorit\u00e9s traditionnelles et les anciens jouent leaders communautaires, plut\u00f4t que vers les tribunaux ou la police. Cette r\u00e9alit\u00e9 s\u2019explique par des facteurs g\u00e9ographiques, \u00e9conomiques, ou simplement par la confiance accord\u00e9e \u00e0 ces m\u00e9canismes locaux. <\/p>\n\n\n\n<p>Toutesfois, ces syst\u00e8mes, bien que profond\u00e9ment enracin\u00e9s, ne garantissent pas toujours l&rsquo;\u00e9quit\u00e9 Les femmes et les jeunes y rencontrent souvent des obstacles, et l&rsquo;absence de r\u00e9gulation peut engendrer des d\u00e9cisions in\u00e9quitables ou incoh\u00e9rentes. Parall\u00e8lement, le syst\u00e8me judiciaire formel, entrav\u00e9 par des ressources limit\u00e9es, des d\u00e9lais prolong\u00e9s et une pr\u00e9sence restreinte en dehors des centres urbains, peine \u00e0 r\u00e9pondre aux besoins de la population.<\/p>\n\n\n\n<p> Le document de strat\u00e9gie \u00a0\u00bbPour une Justice Ax\u00e9e sur les Personnes\u00a0 : proposition de pistes strat\u00e9giques issue de la consultation multi-acteurs\u00a0\u00bb entend r\u00e9pondre \u00e0 ces d\u00e9fis multiples. Elle part du principe que r\u00e9forme efficace doit s&rsquo;appuyer sur les m\u00e9canismes auxquels les citoyens ont d\u00e9j\u00e0 recours (l\u00e0 o\u00fb ils cherchent d\u00e9j\u00e0 la justice). Cela implique de renforcer les capacit\u00e9s des autorit\u00e9s traditionnelles, de garantir que leurs pratiquent respectent les principes d&rsquo;\u00e9quit\u00e9 et les droits humains,\u00a0 et de renforcer les liens entre syst\u00e8mes informels et formels. La strat\u00e9gie repose sur une conviction : la justice ne se mesure pas uniquement \u00e0 l\u2019aune des institutions, mais \u00e0 la capacit\u00e9 des individus \u00e0 se sentir entendus, prot\u00e9g\u00e9s et respect\u00e9s en cas de conflit.<\/p>\n\n\n\n<p><strong>Le R\u00f4le du Comit\u00e9 de Suivi<\/strong><\/p>\n\n\n\n<p>Le comit\u00e9 de suivi r\u00e9unit des repr\u00e9sentants du Minist\u00e8re de la Justice et des Droits de l\u2019Homme, du Minist\u00e8re de l\u2019Int\u00e9rieur et de la S\u00e9curit\u00e9 Publique, de l\u2019Association des Chefs Traditionnels du Niger (ACTN), de la soci\u00e9t\u00e9 civile, des services techniques ainsi que des partenaires financiers. Lors de sa r\u00e9union inaugurale, le comit\u00e9 a adopt\u00e9 une feuille de route commune pour guider la mise en \u0153uvre de la strat\u00e9gie au cours de l\u2019ann\u00e9e \u00e0 venir. Cette feuille de route comprend :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Un plan d\u2019action op\u00e9rationnel, structur\u00e9 autour de calendriers pr\u00e9cis, de responsabilit\u00e9s clairement d\u00e9finies et d\u2019indicateurs de performance mesurables.<\/li>\n\n\n\n<li>Des m\u00e9canismes de coordination visant \u00e0 promouvoir la collaboration entre minist\u00e8res, autorit\u00e9s locales, et prestataires de justice communautaire.<\/li>\n\n\n\n<li>Un cadre de suivi bas\u00e9 sur des r\u00e9unions trimestrielles et des rapports de progression r\u00e9guliers.<\/li>\n\n\n\n<li>Une strat\u00e9gie de communication orient\u00e9e vers le public, visant \u00e0 renforcer la transparence et la confiance des citoyens dans le processus de reformes.\u00a0<\/li>\n<\/ul>\n\n\n\n<p><strong>Le Leadership Traditionnel comme Pilier de la R\u00e9forme<\/strong><\/p>\n\n\n\n<p>Un des aspects les plus significatifs de ce processus r\u00e9side dans la reconnaissance, par l\u2019\u00c9tat, du leadership traditionnel comme pilier strat\u00e9gique du syst\u00e8me judiciaire. Trop longtemps, la r\u00e9solution coutumi\u00e8re des conflits a fonctionn\u00e9 en marge de l\u2019\u00c9tat : efficace, mais non r\u00e9gul\u00e9e. En int\u00e9grant les autorit\u00e9s traditionnelles \u00e0 la fois dans la strat\u00e9gie et sa mise en \u0153uvre, le Niger valorise leur l\u00e9gitimit\u00e9 et renforce ce qui fonctionne d\u00e9j\u00e0 pour une majorit\u00e9 de ses citoyens. La participation de l\u2019ACTN au sein du comit\u00e9 de suivi constitue une avanc\u00e9e structurelle majeure, permettant de transformer le savoir et la l\u00e9gitimit\u00e9 des chefs coutumiers en un cadre de justice respectueux des droits et au service des citoyens.<\/p>\n\n\n\n<p><strong>De la Strat\u00e9gie au Changement Syst\u00e9mique<\/strong><\/p>\n\n\n\n<p>Pour HiiL, l&rsquo;heure est d\u00e9sormais \u00e0 l&rsquo;action. La volont\u00e9 politique affirm\u00e9e ,es partenariats \u00e9tablis, et la feuille de route&nbsp; forment une base solide pour transformer la vision strat\u00e9gique en r\u00e9sultats concrets. La r\u00e9ussite de cette r\u00e9forme repose sur un suivi rigoureux, soutenu par des ressources ad\u00e9quates, un dialogue continu avec les citoyens, et une volont\u00e9 d\u2019apprentissage tout au long de la mise en \u0153uvre.
