{"id":11512,"date":"2021-09-07T12:26:55","date_gmt":"2021-09-07T12:26:55","guid":{"rendered":"https:\/\/www.hiil.org\/?p=11512"},"modified":"2021-09-27T12:31:15","modified_gmt":"2021-09-27T12:31:15","slug":"assessing-the-legal-problems-and-justice-needs-in-america","status":"publish","type":"post","link":"https:\/\/www.hiil.org\/fr\/news\/assessing-the-legal-problems-and-justice-needs-in-america\/","title":{"rendered":"Assessing the legal problems and justice needs in America"},"content":{"rendered":"\n<p><strong>HiiL and IAALS (Advancement of the American Legal System) launched the \u2018US Justice Needs\u2019 report on 1 September and 15 September to reveal insights and the policy implications of America&rsquo;s first nation-wide study on access to justice.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n\r\n<div class=\"fve-video-wrapper fve-image-embed fve-thumbnail-image youtube\" style=\"padding-bottom:75%;\">\r\n    <iframe src=\"\/\/www.youtube.com\/embed\/sd1CTJJ1sCE?wmode=transparent&#038;modestbranding=1&#038;autohide=1&#038;showinfo=0&#038;rel=0\" width=\"100%\" height=\"100%\" frameborder=\"0\" webkitAllowFullScreen mozallowfullscreen allowFullScreen><\/iframe>    <\/div>\r\n\r\n\n<\/div><\/figure>\n\n\n\n<p>\u201cWhile it is widely understood that there&rsquo;s an access to justice problem in the United States, the full extent of the justice crisis has been less clear. [This] lack of clarity regarding the extent of this crisis means that there is a lack of clarity around possible solutions.\u201d<\/p>\n\n\n\n<p>With these words, David Yellen, CEO of the Institute for the Advancement of the American Legal System (IAALS) set the stage for the report launch of our latest Justice Needs and Satisfaction (JNS) study. The \u2018US Justice Needs\u2019 survey reached 10,058 Americans, asking them about the legal problems they have experienced in the last four years, what they did to solve those problems, and ultimately whether they felt they managed to reach a fair resolution.<\/p>\n\n\n\n<p>Funded by the Bohemian Foundation, the nationwide survey is the first of its size in the US to measure how Americans across a broad range of socio-demographic groups experience and resolve their legal problems.&nbsp;<\/p>\n\n\n\n<p>\u201cThis study clearly shows a great diversity of justice needs, sources of help, advice treatments, and interventions for nearly 120 million Americans,\u201d said Sam Muller, CEO of HiiL. \u201c[Americans] need better, faster, and more fair solutions for their legal problems and too many of them are stuck.\u201d<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-full is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/unnamed-5.png\" alt=\"\" class=\"wp-image-11513\" width=\"574\" height=\"332\" srcset=\"https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/unnamed-5.png 512w, https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/unnamed-5-300x173.png 300w\" sizes=\"(max-width: 574px) 100vw, 574px\" \/><\/figure><\/div>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key Findings<\/strong><\/h2>\n\n\n\n<p>The US JNS study provides nationwide representative data on how people in the US experience justice and resolve their justice concerns. With the goal of promoting greater understanding, the report highlights what is working but also what is not, and seeks to inform and assist reform efforts aimed at increasing people-centred justice in the United States.&nbsp;<\/p>\n\n\n\n<p>Highlights from the report include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Access to justice is a broad societal problem\u201466% of the population experienced at least one legal issue in the past four years, with just 49% of those problems having been completely resolved.<\/li><li>While low-income Americans are a particularly vulnerable population, the study shows that the need for fair resolution of legal problems is experienced universally across different groups of the population\u201467% of Americans with household income of less than 25K per year faced one or more legal problems in the last four years.<\/li><li>When we look at the rates at which people encounter legal problems, the relative seriousness of those problems, and the rates at which they were able to completely resolve their legal problems, the following groups stand out as most vulnerable: lower income, women, multiracial and Black Americans, younger and middle-aged, and those living in urban and rural environments. For example, 71% of Black Americans had to deal with legal problems in the last four years.<\/li><li>The JNS study highlights the wide range of negative consequences that result from these legal problems and the justice journeys that people experience. Those negative consequences correlate with problem seriousness, which means that the most serious problems identified are also associated with more negative consequences in people\u2019s lives.<\/li><\/ul>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img decoding=\"async\" src=\"https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-impact-1433x1024.jpg\" alt=\"\" class=\"wp-image-11517\" width=\"671\" height=\"478\" srcset=\"https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-impact-1433x1024.jpg 1433w, https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-impact-300x214.jpg 300w, https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-impact-2048x1463.jpg 2048w\" sizes=\"(max-width: 671px) 100vw, 671px\" \/><\/figure><\/div>\n\n\n\n<p>The study examined only the legal problems of adults over age 18 and did not include hidden populations such as inmates, people living in mental health facilities, or people in hospitals.<\/p>\n\n\n\n<p>\u201cJustice is often compared to education, healthcare and other public policies,\u201d said HiiL\u2019s Director for Measuring Justice, Martin Gramatikov. \u201cThis data and this evidence raise questions such as what if 120 million diseases remained untreated or what if half of the children in the US do not go to school.\u201d<\/p>\n\n\n\n<p>During her presentation, IAALS\u2019 Director of Research Logan Cornett<strong> <\/strong>addressed justice journeys and the actions taken by those seeking to resolve their justice issues. \u201cAbout three quarters of Americans surveyed took some kind of action to resolve their issue. That means they engaged at least one source of legal help, or that they negotiated directly with the other party.\u201d<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img decoding=\"async\" src=\"https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-soh-1-1433x1024.jpg\" alt=\"\" class=\"wp-image-11519\" width=\"655\" height=\"468\" srcset=\"https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-soh-1-1433x1024.jpg 1433w, https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-soh-1-300x214.jpg 300w, https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-soh-1-768x549.jpg 768w, https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-soh-1-1536x1098.jpg 1536w, https:\/\/www.hiil.org\/wp-content\/uploads\/2021\/09\/JNS-USA-SM-soh-1-2048x1463.jpg 2048w\" sizes=\"(max-width: 655px) 100vw, 655px\" \/><\/figure><\/div>\n\n\n\n<p>Additionally, the study helped researchers identify over 820 unique combinations of sources of help that people engaged as they work through their justice journeys. Logan continued, \u201cOf course, there are many differences across problem types and demographic groups but the data tells us that people look to numerous resources and combinations of resources for help in resolving their issues.\u201d<\/p>\n\n\n\n<p>The people who most often took action had issues related to family, public benefits, land, and money related issues. While the people who took action least frequently had government services issues, problems with the police, and traffic and parking.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Using this data to change how we think&nbsp;<\/strong><\/h2>\n\n\n\n<p>\u201cWhat we see from this research is that this access to justice crisis is not just one of low income,\u201d said Brittany Kauffman, the Senior Director at IAALS. \u201cIt is a crisis that extends across the full spectrum of our society, and so that is a critical piece.\u201d<\/p>\n\n\n\n<p>In speaking to the crucial implications of the JNS study, Professor Maurits Barendrecht, HiiL\u2019s Director of Research &amp; Development, emphasised the wealth of data and the opportunities for action.&nbsp; For example, shifting to more online services and platforms to help deliver people-centred justice.<\/p>\n\n\n\n<figure class=\"wp-block-embed aligncenter is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">The US, a litigious society? <br>Access to justice only for the rich? <br>Systemic racial injustice?<br>Will American innovation finally solve the worldwide access to justice problem? <br><br>10.000 Americans provide realistic answers (1). <a href=\"https:\/\/t.co\/jfpBrXlBBI\">pic.twitter.com\/jfpBrXlBBI<\/a><\/p>&mdash; Maurits Barendrecht (@MauritsBarendr) <a href=\"https:\/\/twitter.com\/MauritsBarendr\/status\/1433321808317517830?ref_src=twsrc%5Etfw\">September 2, 2021<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>IAALS and HiiL convened at a second webinar on 15 September 2021 to dive deeper into the takeaways and policy implications of the report.
