Professor Leonard Besselink

Henry G. Schermers fellow for the period of 2011-2012

Leonard Besselink was the Henry G. Schermers fellow for the period 2011-2012. He is a is full professor European Constitutional Law at Utrecht University, the Netherlands.

During the period of his fellowship, Besselink carried out a research focusing on the constitutional nexus between constitutional, European and public international law in the context of globalisation.

His research project aimed to delineate the changes wrought by “globalisation” to the understanding of national constitutions, their role and meaning, with particular emphasis on Europe. Mostly, the literature on globalisation starts from (and often stops at) remarking on the diminished role of national constitutions. On the other hand, there is a very strong body of literature and doctrine on the “constitutionalisation” of international law, as well as “constitutionalisation” of branches of sectors of (in principle national) private law, at least in the European literature.

The research project’s objective was to establish adequate manners (“paradigms”) of understanding the constitutional entwining of legal orders. As such the project is squarely within the remit of the HiiL research programme, since its focus is on structures of understanding how national and international legal orders interact in the European arena.

Leonard Besselink studied law, with a specialisation in European and international law at the University of Leiden (Netherlands), as well as at the Académie de Droit International de la Haye, and at the Johns Hopkins University, School of Advanced International Studies, and holds the doctorate of the European University Institute, Florence, Italy (1989).

Leonard has taught constitutional law at the University of Amsterdam and at present holds the chair in European Constitutional Law at Utrecht University.
