Brainstorm Meeting on HiiL’s Annual Law of the Future Conference 2009
On March 5, 2009 HiiL held a Brainstorm Meeting on HiiL’s Annual Law of the Future Conference 2009. Experts, practitioners, and academics gathered at HiiL’s premises in order to elaborate on the central theme of the Conference, to identify the most relevant and valid topics and related research questions as well as to decide on the structure and the programme of the Conference.
The point of departure for the discussion was the growing importance of private actors in this era of globalisation and their increasing involvement in areas and in the execution of tasks which traditionally are considered to belong to the core responsibilities of states. The participants, however, took note of the evolving attitudes, triggered in particular by current financial crisis, towards taking up of this new role by private actors. With a consensus on the need to search for a new private vs. public equilibrium, as well as for improved private and public cooperation, several core themes such as: legitimacy and effectiveness of various form of private and public cooperation, soft law vs. hard law divide, enforcement, harmonization trends, were identified. Also, the specific areas in which public and private cooperation takes or could take place, such as financial markets, corporate social responsibility, development cooperation were discussed as potential workshop topics.
This fruitful and inspiring Brainstorm Meeting constituted an important step towards the Annual Conference 2009 which will take place on 8 and 9 October 2009 at the Peace Palace in The Hague and will be concerned with Globalisation, the Nation-State and Private Actors.
